By subscribing to or using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how and in whatever category or capacity you subscribe to or use our services.

 

 I.   Legal definitions:

“Designs” shall mean and include Floor plan, 3D exterior design, interior design, and designs by professionals/vendors/third party by whatever name called.

“MOS” shall mean margin of safety.

“Services” shall mean the services offered by Shree NakshaGhar through its application and website.

"Service Providers", “Vendors” shall mean independent third party service providers.

“Sites” shall mean the actual site of the civil construction of the user by whatever name called.

“UPI” shall mean unified payment interface.

"You", "User" wherever mentioned in these terms and conditions shall mean the end user accessing the website by whatever name called.

 

II.   Eligibility:

By accepting the terms and conditions it will be considered that user is fit and proper person, capable and eligible to enter into the contracts and agreements as per the Indian law.

Data provided by the user shall be considered as true, fair and complete and any responsibility of incorrect information shall be of the user.

 

III.   General conditions:

1.      Shree NakshaGhar deals purely in designs. We do not provide any service of visiting the sites physically through any of our representatives or employees.

2.      Shree NakshaGhar does not take responsibility of any lacuna in the designs.

3.      The actual constructible area may differ from the area provided by the user under customize plans, therefore the designs may or may not fit on any area. Shree NakshaGhar does not take responsibility of any designs not fitting on the carpet area, constructible area, area entered by the user by whatever name called. 

4.      Under customization schemes on our application and website, Shree NakshaGhar provides two modification without any additional cost. Further modifications in the designs shall be chargeable as per the pricing policy. 

5.      Designs including customize designs package does not include clearances from any competent local authority like  municipality, development  authority, municipal corporation, village, Tehsil/ blocks or District Panchayat nor does it include any permissions, diversions of land, map clearance, floor plan clearance, margin from road clearance, ground coverage, height of building clearance, service connections, storm water drain permission, permissible build up area, permissible floor space index, fire safety.

6.      Vaastu shastra designs describing principles of design, layout, measurements, ground preparation, space arrangement, and spatial geometry may differ from other professionals, as there is no common principle or methodology followed by every professional.

7.      The watermark of Shree NakshaGhar on the designs by the vendors or service providers is purely for the purpose of branding. Shree NakshaGhar does not claim and responsibility of the designs and layout prepared and listed by the vendors or service providers by whatever name called.

8.      Shree NakshaGhar reserves the right to disclose the identity of vendors or service providers and under no circumstances the identity of the vendors and service providers listed with us shall be shared with the user/customers. Further the identity shall be shared with the service provider of the cloud based services to the extent applicable.

9.      There is a mandatory requirement in some cities and states that a licensed architect or engineer shall review and "seal" a blueprint, or officially approve it, prior to construction.

Prior to application for a building permit or the start of actual construction, Shree NakshaGhar strongly advise that you should consult your local building official for getting a clear view if such a review is required.

10.  The sole liability for completion of the work in case of customization plan shall be of a particular vendor from whom the design have been purchased. It shall be the responsibility of the vendor for timely completion and delivery. If vendors in any way fails to deliver the project Shree NakshaGhar shall be free to get the project completed from any other vendor and further Shree NakshaGhar shall not be liable for any payment to the vendor on this case.

 

IV.   Payment and Fees: 

1.      The payment for the services availed shall be paid at the time of check out. Shree NakshaGhar does not provides any credit facilities on the services availed.

2.      In case of customization plan, payment shall be made by the user at time of check out further Shree NakshaGhar provides two modification without any additional cost. Further modifications in the designs shall be chargeable as per the pricing policy.

3.      Shree NakshaGhar accepts payment through all credit cards, debit cards, UPI and electronic banking channels. We do not accept CASH.

4.      In case any payment get stuck from banks server or due to poor connections, services ordered will be delivered once the payment gets cleared and the same is reflected in our account.

5.      Shree NakshaGhar does not takes any responsibility for the delay in delivering the designs and services to the user due to payment issues.

6.      To avoid any disruption in the payments, please make sure that you have a strong internet connection. Once you have finalized your order please ensure to provide the correct billing information.

V.   Refund Policy:

1.      To Shree NakshaGhar, every project irrespective of its size and nature is important and we ensures that the same is handled with professionalism. We have best of the minds working on such projects and we perceive to deliver sheer excellence. However, there are times wherein expectation doesn’t match with the outcome. In such a case we request you to kindly explore our customization plans with variable pricing.

2.      Being in a service industry we do not entertain refund requests. We offer customization plans at with variable pricing for the convenience of the user.

 

VI.   Delivery Policies:

The delivery commitments by Shree NakshaGhar is subject to the fulfillment of following clause:

1.      Timely payments: A project shall be considered as null and void if the agreed upon / listed payments are not clear.

2.      Timely communication from the client: Any failure in delivery arising out of such situations cannot be attributed to Shree NakshaGhar.

3.      Completeness of information provided by the client: If the information provided to us is incomplete and/or complete information/scope of the project (service and/or product) is not provided at the beginning of the project, Shree NakshaGhar shall not be under any obligation to maintain its delivery commitment.

4.      Shree NakshaGhar will not make any compensation for the delay of delivery under any circumstances listed above unless there is a special agreement signed or committed with a penalty clause for delay in delivery.

 

VII.   Jurisdiction:

1.      Transactions between user and Shree NakshaGhar shall be governed by and construed in accordance with the laws of India for the time being in force, without regard to the laws regarding conflicts of law.

2.      Any litigation regarding this agreement or any transaction between user and Shree NakshaGhar or any action at law or in equity arising out of or relating to these agreement or transaction shall be filed only in the Competent Courts of Indore alone and the customer hereby agrees, consents and submits to the jurisdiction of such courts for the purpose of litigating any such action.

 

VIII.   Privacy Policies:

1.   Shree NakshaGhar periodically reviews its Privacy Policy and reserves the right, at its discretion, to modify or remove portions of this policy at any time. Shree NakshaGhar considers the responsible use of personal information to be of vital importance. This Privacy Policy may be updated by us at any time by posting on the site without any prior notice.

2.   There are times when information will be collected, such as when you use our contact form, for billing purposes, appraisals or in connection with community postings such as message boards or feedback to us or to receive information from us. This information may include your name, home or business address and e-mail address. Personal information will only be collected when knowingly and voluntarily submitted.

3.   We only collect your Personal Information to conduct our business and to enable us to deliver and improve our Services. We do not for any reason whatsoever sell your Personal Information to any third party or otherwise trade on it. However we may disclose it If we are required to intercept, disclose, monitor and/or store your Personal Information: (a) by law (b) to conduct our business (c) to secure our systems and ensure the privacy of our users (d) to enforce our own rights, we will do so in the manner as prescribed by law.

5.   The application registration form requires users to give us contact information (such as name and email address) and demographic information (and other information that is used by us to provide services.) We use the customer contact information from the registration form to send the user information that he or she has requested regarding the application or regarding services offered by us Contact information provided may be used to contact customers when necessary Demographic and profile data is also collected at the Site.

6.   Shree NakshaGhar does not sell or rent out any personal information regarding our users and vendors to any third party. The provision of your personal and or organization information with respect to yourself and including any information on your clients and/or customers will only be used for to offer you a better online experience.

7.   For registration Shree NakshaGhar would require certain information relating to gender, age, preferences, likes, dislikes, physical address, postal address, contact number and mail ID etc. This information is collected to conduct our business and to enable us to deliver and improve our services.

8.   Shree NakshaGhar will seek your permission to send you further communications at the time you provide us with your personal information. If at any time after submitting your personal information to Shree NakshaGhar you would no longer like to receive information from us, simply follow the 'unsubscribe' directions at the end of any e-mail communications you receive.

9.   Shree NakshaGhar reserves the right to modify or make changes in the product without any prior intimation.`

The statistics and log files may be preserved indefinitely and used at any time and in any way necessary to prevent security breaches and to ensure the integrity of the information supplied by Shree NakshaGhar.

11.     In general, on Shree NakshaGhar application, IP addresses are logged to track a user's session while the user remains anonymous.
